Most cancer cases involve the failure to timely diagnose and treat a patient’s cancer. However, additional cancer cases can also include the failure to appropriately treat cancer, and the failure to appropriately monitor the patient following cancer treatment.

Depending on the type of cancer, physicians have an obligation to screen patients for cancer or, at the very least, discuss screening so a patient can make an informed decision whether they want to be screened or not. Some patients also have increased risk factors that physicians should consider when determining whether a patient should be screened. A history of smoking, a family history of cancer, advanced age, and pre-existing medical conditions are typically relevant in determining when and whether a patient should be screened.

Having a lawyer who has experience in handling cancer cases is extremely important because medical malpractice cases tend to be very complex. In New York State, before a lawsuit can even be filed, a patient’s medical records need to be obtained and reviewed by a medical expert.
